TERMS & CONDITIONS

2. Who we are

Ultimate Door of Palm Beach operates under the Ultimate Door brand and related operations of Mosaic Windows and Doors, LLC (“we,” “us,” “our”). References to “services” include consultations, design guidance, project coordination, manufacturing, delivery, installation coordination (where applicable), service, warranty support, and related communications.

3. Website use

3.1 Permitted use

You may use this website for lawful purposes and to learn about our products and services.

3.2 Prohibited use

You agree not to:

  • Interfere with the site’s operation, security, or performance.

4. Estimates, proposals, and pricing

4.1 Estimates are not final until documented

Any verbal discussion, rough ballpark, email note, or “quick estimate” is informational only and is not binding. Pricing becomes binding only when included in a formal written proposal, quote, or agreement issued by us.

4.2 Assumptions and revisions

Quotes and proposals are based on the information provided at the time (dimensions, site conditions, selections, hardware, glass, finish requirements, code requirements, access constraints, etc.). If inputs change, pricing and timing may change.

4.3 Photography and “portfolio” imagery

Images on our website are examples. Natural materials, lighting, camera settings, and post-processing can change how products appear. We do our best to show accurate representation, but you should confirm critical selections in writing.

5. Lead times, scheduling, and changes

5.1 Lead times are estimates

Lead times may vary based on design complexity, supply chain conditions, material availability, permitting, inspections, site readiness, and scheduling constraints. We will communicate material updates as we receive them.

5.2 Scheduling depends on readiness

Install/service scheduling (where applicable) depends on site readiness, safe access, and the availability of decision-makers for approvals. Delays caused by site readiness, other trades, or client-requested changes may shift timelines.

5.3 Change orders

Any change to scope, selections, measurements, or conditions may require a written change order and may affect price, lead time, and delivery.

6. Client responsibilities

You agree to provide accurate, complete, and timely information, including:

  • Correct site dimensions and field verification (where applicable).
  • Clear access instructions, parking, gate approvals, and site contacts.
  • A safe work environment free from known hazards, or disclosure of hazards in advance.
  • Decision-making in a timely manner to avoid schedule drift.

7. Payments and deposits

Payment terms are defined in your written proposal/invoice. Unless otherwise stated, deposits and progress payments may be required to secure materials and production slots.

8. Cancellations and refunds

Custom work is often made-to-order. Once materials are ordered, production begins, or labor is scheduled, certain costs may be non-refundable. Cancellation terms are governed by the written proposal/agreement you sign.

9. Warranty and service

Warranty coverage is governed by the written warranty document provided for your project or product line. If there is a conflict between a warranty document and these Terms, the warranty document controls.

10. Privacy

Your use of the website and submission of information is also governed by our Privacy Policy. If you want maximum discretion, tell us. We are used to operating at that level.

11. Intellectual property

The website content, photography, design, logos, trademarks, copy, layout, and other materials are owned by or licensed to us and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, publish, distribute, or exploit any part of the site content without written permission.

12. Disclaimers

To the maximum extent permitted by law, our total liability for any claim related to the website will not exceed the amount you paid us (if any) for the specific service giving rise to the claim, or $100 if no payment was made.

You agree to defend, indemnify, and hold harmless Ultimate Door of Palm Beach and Mosaic Doors Company and their owners, employees, contractors, and affiliates from any claims, liabilities, damages, judgments, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website, violation of these Terms, or violation of any rights of a third party.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the website will be brought in the state or federal courts located in Florida, unless a signed written agreement provides a different dispute resolution process.
